01 Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the DeliverBud marketplace platform operated by Greenstreet QS LLC doing business as DeliverBud ("DeliverBud," "we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms.

Age Requirement — 21+ YOU MUST BE AT LEAST 21 YEARS OF AGE TO USE THIS PLATFORM. By creating an account or placing an order, you represent and warrant that you are at least 21 years of age. We will verify your age at account creation and at delivery. If you cannot verify your age, your order will not be fulfilled.

02 Platform Description and ICRB Status

DeliverBud is a cannabis marketplace technology platform. DeliverBud is NOT a cannabis retailer, seller of cannabis, employer of delivery personnel, cannabis delivery service, or cannabis licensee of any kind. DeliverBud is an Indirect Cannabis-Related Business (ICRB) that provides:

A marketplace through which adult consumers 21+ discover and order cannabis products directly from licensed NY OCM adult-use retail cannabis dispensaries
Technology infrastructure including order management, compliance enforcement, and delivery tracking
A database of pre-vetted, OCM-trained driver candidates made available to licensed dispensary partners, who independently employ delivery personnel on a W-2 basis to fulfill delivery orders

All cannabis transactions are between you and the licensed dispensary. The dispensary is the seller of record on every order. DeliverBud does not sell, handle, possess, store, or transport cannabis at any point. DeliverBud is not responsible for the quality, safety, labeling, or compliance of cannabis products — that responsibility rests with the licensed dispensary.

03 Account Registration

Provide accurate, complete, and current information at registration and keep it updated
Provide truthful date of birth — we verify that all account holders are 21+
Maintain the security of your account credentials — you are responsible for all activity under your account
Notify us immediately at info@deliverbud.com if you suspect unauthorized access to your account

04 How Ordering Works

Step	What Happens
1 — Browse	Browse licensed dispensary inventory on the Platform. Prices and availability are provided by the dispensary.
2 — Order	Place your order — a purchase offer submitted directly to the licensed dispensary through the Platform.
3 — Compliance check	Every order passes through DeliverBud's automated compliance engine: OCM purchase limits (3 oz flower / 24g concentrate per transaction), delivery hours (9:00 AM to 10:00 PM ET), delivery zone, and 21+ age flag.
4 — Preparation	The dispensary prepares your order in OCM-compliant packaging and affixes a unique QR-coded package label.
5 — Dispatch	A dispensary-employed delivery driver accepts the delivery assignment and picks up your order from the dispensary.
6 — Delivery	At your door: (a) driver scans the package QR; (b) driver scans a QR displayed on your phone; (c) driver checks your government-issued ID — you must be 21+ with valid photo ID. No valid ID = no delivery.
7 — Confirmation	Delivery confirmed. All verification events logged in the tamper-evident audit log.

05 Fees and Payment

Delivery Fee (tiered)	$2.99 for orders under $49 · $4.99 for orders $49–$99 · $7.99 for orders $100+
Service Fee	$4.99 flat per order — for marketplace access and platform services
Cannabis Tax	13% NY adult-use cannabis retail excise tax (9% state + 4% local), collected and remitted by the dispensary
Tip (optional)	5% / 10% / 15% / Custom — 100% goes to the dispensary's delivery driver

Consumer payments for cannabis products are processed directly by the licensed dispensary or its approved payment provider. DeliverBud does not receive, hold, route, or distribute consumer funds at any time. During the pilot phase, some orders may use cash on delivery — the dispensary's driver collects payment at your door on behalf of the dispensary. All sales are final unless the dispensary accepts a return consistent with OCM regulations.

06 OCM Compliance and Purchase Limits

By using this Platform, you agree to:

Not attempt to purchase more than OCM per-transaction limits (3 oz of cannabis flower or 24g of concentrated cannabis per transaction)
Not attempt to circumvent purchase limit detection by placing multiple orders within a 24-hour period
Not request delivery to prohibited locations including public spaces, parks, school grounds, or motor vehicles
Not place orders outside permitted delivery hours (9:00 AM to 10:00 PM ET)
Produce valid government-issued photo ID proving you are 21+ at every delivery — no exceptions

07 Prohibited Uses

Purchasing cannabis for resale or distribution
Purchasing cannabis on behalf of a person under 21 years of age
Fraudulent orders, chargebacks, or payment disputes without valid cause
Providing false age or identity information
Using another person's account or payment method without authorization
Any use that violates applicable federal, state, or local law

08 Delivery Personnel

Deliveries are performed by delivery personnel who are independently employed on a W-2 basis by licensed dispensary partners. Each dispensary partner is the employer of record for its delivery personnel and is solely responsible for their supervision, compensation, payroll, and compliance with applicable employment law. DeliverBud is not the employer of delivery personnel and is not responsible for their payroll, supervision, or compensation.

All delivery personnel are at least 21 years of age, background-checked, credential-verified, and trained on all four components of OCM Responsible Workforce Training under 9 NYCRR §125.5 before being made available to dispensary partners through the platform.

09 Intellectual Property

The DeliverBud platform, including all software, technology, content, branding, and design, is owned by Greenstreet QS LLC and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or exploit any portion of the Platform without our prior written consent.

10 Disclaimers and Limitation of Liability

The platform is provided "as is" without warranty of any kind. DeliverBud is not a cannabis retailer and is not responsible for the quality, safety, potency, labeling, or compliance of cannabis products sold by dispensary partners. All product liability rests with the licensed dispensary.

To the maximum extent permitted by law, DeliverBud's total liability for any claim shall not exceed the total fees paid by you to DeliverBud in the three (3) months preceding the claim. DeliverBud shall not be liable for any indirect, incidental, consequential, special, or punitive damages.

11 Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York. Disputes shall first be subject to good-faith negotiation for thirty (30) days. If not resolved, disputes shall be submitted to binding arbitration in New York, NY under AAA rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.

12 Changes to Terms

DeliverBud may update these Terms from time to time. Material changes will be communicated to registered users by email and posted on deliverbud.com at least fourteen (14) days before taking effect. Questions about these Terms? Contact us at legal@deliverbud.com.
